COVID-19 National Emergency and Public Health Emergency Ending, Affecting Group Health Plans

The Biden administration recently announced the COVID-19 national emergency and public health emergency will end on May 11, 2023. As a result, the “outbreak period” will end on July 10, 2023 and certain group health plan requirements will also end:

  • No cost over-the-counter COVID-19 tests;
  • No cost COVID-19 testing prescribed by a healthcare provider;
  • No cost COVID-19 vaccines provided by an out-of-network provider.

Plans may choose to extend these benefits until the end of the current plan/policy year to avoid mid-year disruptions or they may choose to amend plan benefits mid-year to take immediate advantage of the changes.
